Carbarn Botswana – Terms & Conditions

1. Introduction

These Terms and Conditions ("Agreement") govern the use of our services between you (the "Purchaser") and Carbarn LLC, a Japan-based company ("Carbarn", "we", "us", or "our"). By purchasing a vehicle through the Carbarn Botswana website, you agree to these terms.

Carbarn Botswana is not a legal entity in Botswana—we operate internationally from Japan under Carbarn LLC.

2. Nature of Business

  • Carbarn LLC is a Japan-based vehicle exporter.
  • All transactions, vehicle ownership, and documentation originate from Japan.
  • We do not engage in local sales, vehicle registration, or after-arrival services in Botswana.
  • Our liability and responsibility end upon delivery at the designated export port (typically Durban, South Africa).

3. Legal Jurisdiction

  • All purchases are made under Japanese law, and any disputes shall be resolved only under the jurisdiction of the Japanese courts.
  • We do not engage in legal matters within the Republic of Botswana or any other customer country.

4. Vehicle Condition & Inspection

  • All vehicles are inspected in Japan before shipment.
  • We provide auction sheets, inspection reports, Bill of Lading, and invoices.
  • Vehicles are sold "as-is" with full transparency; odometer tampering is strictly prohibited.
  • Post-arrival vehicle inspections are the customer’s responsibility in Botswana.

5. Shipping & Delivery

  • Vehicles are shipped via RoRo (Roll-on/Roll-off) or container through Durban Port.
  • Estimated delivery time: 6–8 weeks from confirmation of full payment.
  • Shipping schedules may vary and are managed by the shipping company.
  • Shipping insurance is provided by third-party shipping agents, not Carbarn.

6. Payment Terms

  • 100% payment must be made before shipment.
  • We accept USD or JPY via secure bank transfer.
  • Exchange rate fluctuations and bank charges are borne by the Purchaser.
  • Once the payment is received and confirmed, shipment arrangements will begin.

7. Customs & Clearance in Botswana

  • All customs clearance, import duty, VAT, registration, and licensing within Botswana are the sole responsibility of the Purchaser.
  • Carbarn does not provide clearance services or act as a clearing agent, though we may offer advice where possible.

8. Refund & Cancellation Policy

  • Orders may only be cancelled prior to shipment, and only at the discretion of our supplier.
  • No cancellations or refunds are accepted once the vehicle has been shipped.

9. Liability Disclaimer

  • Carbarn is not responsible for delays, damages, or losses once the vehicle has been shipped.
  • We are not liable for border or port delays, clearance issues, or third-party service problems.
  • All vehicles are exported under buyer’s responsibility upon handover to shipping.

10. Privacy & Data Use

  • We collect only necessary information to process and deliver your order.
  • Please refer to our Privacy Policy for full details on how your data is handled.

11. Governing Law

This Agreement shall be governed by and interpreted under Japanese law. All legal matters shall be settled in the courts of Japan.
